General terms and conditions of sale

Foreword

The services offered by Prométhée Consultants are governed by the present terms and conditions of sale, which take precedence over all others.

By confirming his/her order, the buyer gives his/her irrevocable and definitive consent to all the provisions of the present terms and conditions of sale.

Prométhée Consultants reserves the right to modify them at any time. In this case, the applicable conditions will be those in force at the date of the customer’s order.

Features of the services offered

Prométhée Consultants offers a wide range of solutions and training courses available on its website (prometheeconsultants.ca.).

  • The dates and locations of sessions indicated on the site do not constitute a final commitment on the part of Prométhée Consultants.
  • Customers can register for training sessions at any time on the prometheeconsultants.ca website, and will shortly receive confirmation of registration, as well as login details in the case of online training.

Prométhée Consultants reserves the right ::

  • To cancel if the number of registered participants is insufficient; those who have paid the registration fee will receive a credit or refund.
  • Refuse or cancel a registration.

Period of validity of the offer

The service is valid until it has reached it’s legal validity, as determined by Prométhée Consultants, or until the dates specified in the training agreement.

Pricing and payment

Unless otherwise indicated, prices displayed on prometheeconsultants.ca are guaranteed firm and final.

Fees must be paid in full prior to the start of training. In the event of late payment, interest will be charged on the amount due.

Only credit cards are accepted for payment.

There is no registration deadline. However, it is important to register as early as possible.

Cancellations, deferrals and substitutions

It is entirely possible to postpone an activity. A postponement is treated as a cancellation, and the same conditions apply.

Substitutions

Substituting a participant in the same activity are accepted free of charge.

Service availability

The service provider commits to providing a quality service.

Act of God

Neither party may hold the other party liable in the event of delay or impediment in the performance of the contract due to an « act of god », unforeseen circumstances or an external cause, such as, in particular, natural disasters, strikes, industrial disputes, water damage, power failures or telecommunication network interruptions. If the case of an act of God persists for more than one (1) month, the present general conditions of sale may be terminated by the injured party, and the parties will be released from their respective obligations.

Right of use and usage

Prométhée Consultant grants only a limited right to use the training content and resources. The contract between the parties is a contract for the provision of services, the main feature of which is access to the chosen training course for a fixed period. Connection codes supplied by the provider are strictly confidential and personal. In the event of illegal use of these codes, the provider reserves the right to cancel the access rights in question without prior notice, and no reimbursement may be requested. Furthermore, the service provider reserves the right to hold the customer liable.

Resolutory clause

If the customer fails to meet its obligations, the service provider may terminate the contract unilaterally, without waiving the right to claim compensation or penalties for delay.

Privacy policy

As a service provider, Prométhée Consultant collects, stores and transfers personal data in order to carry out educational missions, offer efficient technical assistance and manage its customers’ data.

These activities are carried out in compliance with current regulations on the protection of personal data and with respect for the privacy of the individuals concerned.

The service provider undertakes to comply with the measures arising from current Canadian legislation, in particular the Privacy Regulations (CG32):

  • Personal data will be processed solely for the specific purpose set out in this agreement.
  • Prométhée Consultants guarantees the confidentiality of personal data processed.
  • Prométhée Consultants undertakes to respond to requests to exercise the rights of the persons concerned, including the rights of access, rectification, erasure, opposition, limitation of processing and data portability.
  • Prométhée Consultants will notify the data controller of any violation of personal data. This notification will be accompanied by all documentation necessary to enable the data controller, where applicable, to notify the competent supervisory authority of the violation.
